According to an arrest affidavit, Horner was delivering a package to Athena’s home. He allegedly struck the girl with his FedEx truck while backing out of the driveway. The package reportedly contained a Christmas gift for Athena.
Horner told investigators Athena was not seriously injured from the impact. He stated he ‘panicked’ and took her into his van. He was allegedly worried she would tell her father what happened.
Video from inside the truck showed Horner talking to Athena. He later told detectives she told him her name. This detail is contained within the arrest affidavit.
Wise County District Attorney James Stainton intends to seek the death penalty. Horner was indicted for capital murder and aggravated kidnapping in February 2023. He pleaded not guilty to both charges later that year.
Legal analyst Paul Coggins said the case may hinge on sentencing. He cited the young age and vulnerability of the victim. The nature of the victim has brought the case significant attention.
